FAMILY CASES (Divorce, Legal Separation, Custody and Support, Distribution of Assets and Allocation of Debts)

DOMESTIC VIOLENCE

In the event of domestic violence,  it is often necessary for a spouse, domestic partner, or family member to seek a restraining order.  Whent he necessity arises, Shelly stands ready to quickly assist her clients in obtaining the court orders necessary to protect you and your family.  protection . Should her client be served with a temporary restraining order brought by someone else, Shelly will aggressively assist in defending against that restraining order.

PRE  AND POST MARITAL AGREEMENTS

Your getting married.  Its the greatest time of your life.  But, if like half all married couples, you find yourself getting a divorce down the road, having a pre or post marriage agreement may be the best decision you could make.  A pre/post marital agreement can 1) prevent the creation of community property during the marriage and/or 2) ensure that any separate property you brought into the marriage is not considered community to which your ex spouse would be entitled to half.  Even after you marry, you may enter into an agreement with your spouse to make clear what each of your interests are to property acquired the marriage.  Shelly will discuss all your options and prepare a contract that meets your specific needs and wishes.    

STEP-PARENT ADOPTIONS

When your new life partner wishes to adopt your child or children from a previous relationship, Shelly will assist you to determine the feasibility of such an action for you, your children, and your partner.  We will then assist you in achieving the joyful building of a new family unit.

Proper estate planning allows you not only to remain in control over your assets and your health, but avoids costly probate and attorney fees that your family will have to pay in order to transfer your estate to your beneficiaries. Shelly will assist you in placing your wishes in writing so that your intentions and desires will be followed during your life and afterward.  We provide services in such areas as wills, living trusts, powers of attorney for health care, durable powers of attorney, and directives to physicians.
